Terms of Use

Welcome to Sleep Coach (the "App"). These Terms of Use govern your use of the Sleep Coach app and its Premium subscription, both operated by Softweb. By downloading, installing or using the App, you agree to these terms. If you do not accept the terms, please do not use the App.

1. License and Right to Use

Subject to your compliance with these terms, Softweb grants you a limited, non-exclusive, revocable, non-transferable license to use the App for personal, non-commercial purposes. You agree not to:

Reverse engineer, attempt to extract source code from, or modify the App
Resell, rent, or redistribute Premium content to others
Use the App with automated tools, bots, or scripts
Interfere with other users' experience of the App
Use the App in any way that violates laws or infringes others' rights

2. ⚠️ Medical Disclaimer (Important)

Sleep Coach is not a medical device. The App is intended only for informational, educational, and personal wellness purposes. It does not substitute medical advice, diagnosis, or treatment, and is not designed to do so.

Things you need to know about the App's features:

Sleep stage analysis and score: Based on smartphone sensors and audio analysis; not as accurate as clinical polysomnography (PSG).
Apnea screening, Chronotype test, Sleep Need calculation: General screening tools based on scientific scales (STOP-Bang, MEQ, etc.). They do not provide medical diagnosis. If you see a high-risk indicator, consult a sleep medicine specialist.
AI Coach responses: General information generated by artificial intelligence. Not medical advice.
Sound event classification (snoring, etc.): Automatic estimation with margin of error. Diagnosis of conditions like sleep apnea requires medical evaluation.
Frequencies and meditative sounds: For relaxation purposes only; no claim is made to treat any health condition.

If you experience any of the following, use the App for information only and consult a healthcare professional:

Severe or chronic insomnia
Suspected sleep apnea (excessive daytime sleepiness, breathing pauses reported by a partner, etc.)
Symptoms of Restless Leg Syndrome or narcolepsy
Sleep-related depression, anxiety, or suicidal thoughts
Pregnancy or breastfeeding period (alarm/sound use with physician approval)

In emergencies, call your local emergency number. Sleep Coach does not provide emergency medical aid or crisis intervention services.

3. Sleep Coach Premium Subscription

3.1 Subscription Types

A Premium subscription unlocks features that are locked in the free version (advanced sleep analysis, unlimited sound recording access, all meditative sounds, unlimited AI Coach messaging, premium frequencies, etc.). Subscription terms may be monthly or yearly; pricing is shown in-app.

3.2 Automatic Renewal

Your Premium subscription renews automatically. Unless you cancel through your Google Play account at least 24 hours before the end of the current subscription period, your subscription fee will be automatically charged and the subscription will continue under the same terms.

3.3 Cancellation

You may cancel the subscription at any time through the Google Play app (Profile > Payments & subscriptions > Subscriptions)
After cancellation, Premium features remain available until the end of the currently paid period
To resubscribe, return to the Premium screen within the App

3.4 Refunds

Refunds are subject to Google Play's refund policies. Standard practice:

Cancellation by itself does not trigger an automatic refund — you continue Premium use until the end of the current period
For refund requests, contact the Google Play Help Center
Statutory rights of withdrawal under applicable consumer law are reserved; requests may be filed via Google Play within the legal withdrawal period

3.5 Free Trial (if applicable)

You have access to Premium features during the free trial period
Unless you cancel at least 24 hours before the trial ends, you will automatically be converted to a paid subscription and charged
If you cancel within the trial period, no charges are made

3.6 Price Changes

We reserve the right to change subscription prices. Significant price changes will be communicated through in-app notification before renewal. New prices apply only to renewals after the announcement; the price of your current paid period does not change. If you do not accept the new price, you may cancel the subscription.

3.7 Payment

All payments are processed through Google Play Billing. Softweb does not see or store your credit or debit card details. Payment information is only between you and Google.

4. Account and Personal Data

Sleep Coach does not require registration or account creation. Detailed sleep data (session records, audio events, personal settings) is stored on your device; anonymous usage statistics are processed via Google Firebase Analytics. For details on data processing, please read our Privacy Policy.

5. Intellectual Property

The Sleep Coach app, its logo, brand name ("Sleep Coach"), design, interface, texts, and original content are intellectual property of Softweb.
Open-source software used by the App (AndroidX, Compose, Media3, etc.) is used under their respective open-source licenses.
Third-party music, audio content, and graphics are provided under Creative Commons (CC0/CC-BY) or public domain licenses, or are produced by Softweb itself.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

Sleep Coach is provided "as is" and "as available"; we make no express or implied warranties.
We are not liable for indirect, consequential, special, or punitive damages arising from situations such as alarm not ringing, ringing at the wrong time, app crashes, data loss, incorrect sleep score calculation, or inaccuracies in AI Coach responses.
For direct damages, our total maximum liability is limited to the amount you have paid for a Premium subscription in the 12 months prior to the claim date (zero if no Premium subscription).
These limitations do not apply where prohibited by applicable law (e.g., consumer statutory rights, willful misconduct, or gross negligence).

7. Termination

If you breach these Terms — particularly the prohibited actions in Section 1 — we reserve the right to terminate your Premium subscription and suspend your access to the App.

You may terminate your relationship at any time by uninstalling the App from your device. Premium subscription must also be cancelled via Google Play.

8. Changes to These Terms

We may update these Terms of Use from time to time. Significant changes will be notified via in-app notification and by updating this page. Continued use of the App after such changes constitutes acceptance of the updated terms. If you do not agree to the changes, you may cancel the subscription and uninstall the App to end your relationship.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. For all disputes arising out of or related to these terms, Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction. Consumer rights to bring claims under the Turkish Consumer Protection Law (Law No. 6502) are reserved; consumers may apply to consumer arbitration boards and consumer courts.

10. Severability

If any provision of these Terms is found invalid or unenforceable by a competent court, the remaining provisions will continue in full force and effect.
